Terms of Service

1. Agreement to Terms

By accessing or using taskdwell ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

taskdwell is a home maintenance management platform that provides:

• Automated task scheduling and reminders
• Home inventory and warranty tracking
• Document storage for manuals and receipts
• Calendar integration and notifications
• Multi-property management tools

3. Account Registration

To use taskdwell, you must:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Be at least 18 years old or have parental consent
• Not share your account with others

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights of others
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Use automated tools to access the Service without permission
• Resell or commercially exploit the Service without authorization

5. Subscription and Payment

Starter Plan: Free forever. One property, weekly AI scan, 5 diagnostic chats per month, and a preview of Property Health.

Paid Plans: Homeowner and Investor require a monthly or annual subscription. Enterprise (11+ properties) is a contact-us tier with custom pricing:

• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled
• All fees are in USD and non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

Free Trial: New paid subscribers receive a 14-day free trial. Your payment method will be charged automatically at the end of the trial period unless you cancel.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You retain access until the end of your current billing period
• Your account becomes read-only after the billing period ends
• Your data is retained for 90 days before permanent deletion
• No refunds are provided for partial months or unused time

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using taskdwell, you consent to our collection and use of your data as described in the Privacy Policy.

Your Content: You retain all rights to the content you upload (photos, documents, notes). You grant us a license to store, process, and display this content solely to provide the Service.

Data Export: You may download a JSON export of your data at any time by signing in and visiting /api/user/data/export. See the Privacy Policy for details.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by taskdwell and protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without explicit permission.

9. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted access. The Service may be temporarily unavailable for:

• Scheduled maintenance (with advance notice when possible)
• Emergency repairs
• Factors beyond our control (network outages, DDoS attacks, etc.)

We are not liable for any losses resulting from service interruptions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• taskdwell is provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
• We are not responsible for any property damage or maintenance issues that occur
• Task reminders and schedules are suggestions only—you are responsible for your home maintenance

11. Disclaimer

taskdwell provides informational tools and reminders. We do not:

• Provide professional advice regarding home maintenance, repairs, or safety
• Guarantee that following our suggestions will prevent damage or issues
• Warranty the accuracy or completeness of maintenance schedules
• Assume liability for work performed by contractors or service providers

Always consult qualified professionals for home maintenance and repair decisions.

12. Indemnification

You agree to indemnify and hold harmless taskdwell, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party

13. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Breach these Terms
• Engage in fraudulent activity
• Violate applicable laws
• Abuse the Service or other users

Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via:

• Email to your registered address
• Prominent notice on the Service
• Update to the "Last updated" date at the top of this page

Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for claims that may be brought in small claims court.
